NEWPORT NEWS, Va. ? Dressed in blue jeans and short-sleeve cotton shirts, wet grass clippings caked on their shoes, Whitney and Fred Farris look comfortable and relaxed as they stroll their family farm, a 300-acre elongated point of lush land on the Nansemond River in southeastern Virginia.

The farm is where the couple spends weekends and many vacation days, tending to more than a dozen beds of various sizes they?ve created on two acres.

Collectively, their plantings are called Long Point Gardens.

Organic gardeners for decades, they prefer the aromas of aged compost and ripening heirloom vegetables and fruits instead of the smells of gas fumes from traffic along city streets. They dig many beds by hand, and Fred fashions trellises, pergolas and fences from fallen branches and sticks. Tools are kept in a vintage corn crib, which is now officially their gardening shed.

?We have been organically gardening together even before our marriage on a North Carolina organic farm in 1980,? says Fred, deputy director of the educational Virginia Living Museum (www.thevlm.org) in Newport News, Va., since 1999. Many of Fred?s conservation ideas have been incorporated into programs at the museum, including the Living Green exhibit with a green roof, rain barrels, compost system, energy-conserving tips and earth-friendly building methods and products, according to Christine Lewis, museum education director, and other staff members. Fred is also a member of the local Green Building Council.

?The physical gardening work is not really work but fulfilling exercise that has made us both healthier. Being outdoors and tending the garden is invigorating and fun,? he says.

After restoring the farmhouse on the Suffolk property from 1980 to 1983, they moved to the city to raise a family.

Although the couple gardens at the farm, their crops begin at their city home. Seeds are started on heat mats under grow lights, and then the seedlings are transferred to a small backyard greenhouse before transplanted into Suffolk soil.

?We provided all the cut flowers for our daughter?s wedding on the property in 2008,? says Fred.

The couple sticks to strict organic techniques using horse manure and bedding from a nearby farm to establish compost beds that fertilize the gardens. Dormant oil helps control insect issues on fruit and nut trees ? apple, pear, plums, figs, pomegranate, cherry, pecan, English walnut, persimmon, apricot, trifoliate orange, Chinese chestnut and hazelnut. They harvest two kinds of kiwi ? fuzzy and smooth Russian, both cold hardy in Hampton Roads, Va.

They hand weed, mulch extensively and grow cover crops such as crimson clover, buckwheat and wheat during winter to improve soil conditions for upcoming plantings. No pesticides or commercial fertilizers are used, and limited botanical sprays and soaps eliminate most pests on other plants.

Gardening organically and diversely, especially with native plant mixes, brings increasing numbers of butterflies, bees and other good wildlife to the gardens, they say.

(AP) ? The clock struck midnight, and the NHL turned into another sports league closed for business.

Unable to reach agreement on a new labor deal, the National Hockey League locked out its players at 12:01 a.m. Sunday, the third major pro sport to impose a work stoppage in the last 18 months, behind the NFL and NBA.

The action also marks the fourth shutdown for the NHL since 1992, including a year-long dispute that forced the cancellation of the entire 2004-05 season when the league successfully held out for a salary cap.

That fight ended with the latest collective bargaining agreement, and when it ended Commissioner Gary Bettman followed through on his longstanding pledge to lock out the players if no deal was in place.

NHL Deputy Commissioner Bill Daly confirmed the shutdown was in effect. The union said it would have no comment.

The sides were so far apart in their discussions that they didn't even meet face-to-face for negotiations on Saturday.

The core issue is money ? how to split a $3.3 billion pot of revenue. The owners want to decrease the percentage of hockey-related revenue that goes to players, while the union wants a guarantee that players annually get at least the $1.8 billion in salaries paid out last season.

Hours before the deadline, the lockout was considered a foregone conclusion.

"We talked with the union this morning, and in light of the fact that they have nothing new to offer, or any substantive response to our last proposal, there would be nothing gained by convening a bargaining session at this time," Daly said in a statement earlier Saturday. "I'm sure that we will remain in contact in the coming days."

The dispute is latest chapter in labor unrest that has vexed American professional sports. The NFL was locked out for much of the offseason in 2011 while the last NBA season was shortened from 82 games to 66 and began on Christmas.

Baseball successfully reached a labor deal and some have suggested that the fact MLB didn't have a work stoppage has to do with the fact that baseball has no salary cap, allowing for more wiggle room in negotiations.

Despite a third straight day of telephone discussions between Daly and players' association special counsel Steve Fehr, the brother of NHLPA executive director Donald Fehr, hopes of face-to-face talks were dashed early Saturday.

"We suggested that the parties meet in advance of the owners' self-imposed deadline of midnight tonight," Steve Fehr said Saturday in a written statement. "Don Fehr, myself and several players on the Negotiating Committee were in the City and prepared to meet. The NHL said that it saw no purpose in having a formal meeting.

"There have been and continue to be private, informal discussions between representatives of both sides."

It now appears unlikely that training camps will open next week. The regular season is scheduled to begin Oct. 11, but that is also in peril.

"It's a sad situation for everybody. Nobody wants to be in this spot," Detroit Red Wings defenseman Niklas Kronwall said. "We couldn't agree on a deal. We see it one way, and the owners another way unfortunately."

One sign of the split: The NHL's website went from featuring current players to remembering great moments in the sport, such as the 1987 Canada Cup.

While the NHL lockout might not wipe out the whole season as the one in 2004-05 did, a sizeable chunk of games could be lost without productive talks soon.

In jeopardy are a couple of key dates on the calendar: the New Year's Day outdoor Winter Classic at 115,000-seat Michigan Stadium between the host Detroit Red Wings and the Toronto Maple Leafs; and the Jan. 27 All-Star game hosted by the Columbus Blue Jackets, one of the league's struggling small-market teams.

The sides traded proposals Wednesday, but neither new offer moved them closer to a deal. The lack of progress then made a lockout almost inevitable.

"I think it's fair to say there was no realistic expectation to avoid lockout as of developments on Wednesday and Thursday," Daly told The Associated Press.

Bettman has insisted that hockey management is determined to come away with economic gains, even at the cost of another work stoppage. Financial damage is certain to occur almost immediately, and there is no telling how jilted fans and sponsors will react to another shutdown, especially if it lasts through the fall and into the winter.

Players are concerned management hasn't addressed the league's financial problems by re-examining the teams' revenue-sharing formula. Having made several big concessions to reach a deal in 2005, the union doesn't think it should have to make more this time after record financial growth.

Once the lockout was imposed in September 2004, the sides didn't get back together until December. That stalemate was finally resolved in July 2005.

Players absorbed a salary-cap system ? the major issue then ? and took an immediate 24 percent rollback of existing contracts in exchange for 57 percent of hockey-related revenues. The NHL now says that figure is too high, and wants to reduce players' share to a range between 49 percent and 47 percent.

Its original offer was to cut it to 43 percent.

Bettman said the league's latest offer would be pulled off the table once the current CBA expired because the hardship caused by a lockout would force the NHL to reassess what it could then offer.

Without a philosophical difference this time over the salary cap, the sides merely have to figure out a way to divide hockey revenues that grew from $2.1 billion to $3.3 billion under the expiring deal.

On Friday, the Quebec labor relations board rejected a request from the players' association for a temporary injunction against a potential lockout in Quebec. But the board also ruled that more hearings are needed to make a final decision.

NHL players struck in April 1992, causing 30 games to be postponed. This marks the third lockout under Bettman. The 1994-95 lockout ended after 103 days and the cancellation of 468 games.

The most recent stoppage was settled after 301 days and a month after the league would have awarded the Stanley Cup. It marked the first time a North American professional sports league lost an entire season because of a labor dispute, and the first time the Stanley Cup wasn't handed out since 1919, when a flu epidemic prevented a champion from being crowned.

Mixed grades for new, healthy school lunch rules

ROTTERDAM, N.Y. (AP) ? One student complains because his cafeteria no longer serves chicken nuggets. Another gripes that her school lunch just isn't filling. A third student says he's happy to eat an extra apple with his lunch, even as he's noshing on his own sub.

Leaner, greener school lunches served under new federal standards are getting mixed grades from students piling more carrots, more apples and fewer fatty foods on their trays.

"Now they're kind of forcing all the students to get the vegetables and fruit with their lunch, and they took out chicken nuggets this year, which I'm not too happy about," said Chris Cimino, a senior at Mohonasen High School in upstate New York.

Lunch lines at schools across the country cut through the garden now, under new U.S. Department of Agriculture nutrition standards. Mohonasen students selecting pizza sticks this week also had to choose something from the lunch line's cornucopia of apples, bananas, fresh spinach and grape tomatoes, under the standards. Calorie counts are capped, too.

Most students interviewed in this suburban district near Schenectady seemed to accept the new lunch rules, reactions in line with what federal officials say they're hearing elsewhere. Still, some active teens complain the meals are too skimpy. And while you can give a kid a whole-wheat pita, you can't make him like it.

"I was just trying to eat it so I wouldn't be hungry later on," Marecas Wilson said of his pita sandwich served this week at Eastside Elementary in Clinton, Miss.

Though the fifth-grader judged his pita "nasty," he conceded: "The plum was very good."

Kim Gagnon, food service director in the Mohonasen district, said while students generally have been receptive to the fruits and vegetables, "we have noticed that kids are throwing it out or giving it to friends, leaving it on counters, so we haven't quite gotten there yet."

The guidelines approved by the USDA earlier this year set limits on calories and salt and phase in whole grains. Schools must offer at least one vegetable or fruit per meal. They can still serve chocolate milk, but it has to be nonfat.

The biggest update to federal school-food guidelines in 15 years might please parents who recall washing down cheeseburgers and tater tots with full-fat chocolate milk. In Pueblo, Colo., Megan Murillo said she feels more comfortable letting her first-grader, Sophie, eat cafeteria-prepared lunches knowing there are more vegetable and whole grains.

Reactions in schools so far this fall have been positive, according to Kevin Concannon, the USDA's undersecretary for Food, Nutrition and Consumer Services.

"I don't mind it because I always got the extra apple and fruit and veggies and all that," said Anthony Sicilia, a senior at Mohonasen, who nonetheless was eating a Subway sub for lunch. "But I think it's good because it actually forces kids to eat healthy."

But new guidelines or no, many kids are still picky eaters.

In Clinton, Miss., the elementary students served flatbread roast beef sandwiches with grated cheese ate most of the meat but left large chunks of whole-wheat pita. Most plums were gnawed to the pits, and several salads were half eaten.

"I liked the meat but not this," fifth-grader Kenmari Williams said, pointing to his pita. "Every time you eat it, you get something white on your hands."

One thornier complaint is that the new lunches are too little for active teens now that the calorie range for high school lunches is 750 to 850. Rachelle Chinn, a freshman from Clarence, Mo., who plays softball, said school lunches are now so slight it once left her with a headache.

"The fruits and vegetables are good at first but once they wear off, I get hungry," she said. "It's just not enough to get me through the day."

Her mom, Chris Chinn, now packs her protein-heavy snacks like peanut butter crackers and granola bars. Chinn, a critic of what she calls the "one size fits all" standards, said many athletes aren't getting enough to eat. Similarly, Katie Pinke in Wishek, N.D., gave up on school lunches for her strapping freshman son Hunter and packs him meaty sandwiches.

Hunter is a 6-foot-5-inch, 210-pound football player who, based on his size and active lifestyle, needs more than 4,700 calories daily to maintain his weight. He said lunches topping out at 850 calories aren't enough.

"I think it's kind of ridiculous that people say how much we get to eat when there are a lot of kids that are big," Hunter said. "When we can't have our meat and bread, for a guy especially, it's not fun."

Concannon noted the calorie ranges are adjusted for age, increasing as students move from elementary to middle to high school. If some children need more, Concannon said, schools have the option of offering an afternoon snack or parents can send snacks from home.

"If you look at colleges in the United States, if you've ever looked at the tables where they're feeding just the football players. Good God ... If you emulated that, we'd all be wearing size 48 suits by our 20s," he said. "You have to use common sense."

And just weeks into the school year, it's probably too early for final grades. In Mississippi, Keba Laird, child nutrition supervisor for the Clinton district, said she is phasing in the nutritional changes to help children grow accustomed to eating healthier.

"We don't want a revolt on our hands," she said. "We want them to enjoy eating with us."

US futures dip ahead of Fed decision

NEW YORK (AP) ? Stock futures slid ahead of a Fed decision Thursday over the best course of action to revive the economy, with many believing that there may be too much optimism about bold action from policy makers.

The Federal Reserve will come to a decision just after noon, and Chairman Ben Bernanke is expected to speak at 2:15 p.m. Eastern.

Dow Jones industrial futures fell 21 points to 13,340. The broader S&P futures gave up 2.7 points to 1,436.80. Nasdaq futures slipped 7 points to 2,789.

Futures have been rising throughout the week and on Thursday it appeared that many investors believed that any decisive action from the Fed, such as third round of bond purchases, has already been priced in.

There are also some jitters over events in the Middle East. Protesters stormed the U.S. Embassy compound in Yemen's capital Thursday and there is violence around the U.S. mission in Cairo.

The attacks come a day after the U.S. announced the death of its ambassador to Libya, where the American compound was overrun. The protests were sparked by an amateurish video produced in the U.S. called "Innocence of Muslims," which mocks Islam's Prophet Muhammad.

The attacks have pushed crude prices higher. Oil was trading above $97 per barrel on the New York Mercantile Exchange.

The Labor Department also reported Wednesday that unemployment claims rose 15,000 to 382,000, pushed up by Tropical Storm Isaac. And a sharp rise in gasoline costs, due to the hurricane and refinery issues, drove up wholesale prices last month at a faster rate than has been seen in more than three years.

Removing energy and food costs, however, the increase in prices has been mild.

The Labor Department reported that the producer price index, which measures price changes before they reach the consumer, jumped 1.7 percent in August. Excluding the volatile food and gas categories, core wholesale prices rose only 0.2 percent, below July's increase.

Genetic make-up of children explains how they fight malaria infection

Researchers from Sainte-Justine University Hospital Center and University of Montreal have identified several novel genes that make some children more efficient than others in the way their immune system responds to malaria infection. This world-first in integrative efforts to track down genes predisposing to specific immune responses to malaria and ultimately to identify the most suitable targets for vaccines or treatments was published in the Proceedings of the National Academy of Sciences by lead author Dr. Youssef Idaghdour and senior author Pr. Philip Awadalla, whose laboratory has been performing world-wide malaria research for the past 13 years.

"Malaria is a major health problem world-wide, with over 3 billion individuals at risk and hundreds of thousands of deaths annually, a majority of which are African children under the age of 5. Why are some children prone to infection, while others are resistant and efficiently fight the disease? These are the questions we sought to answer with our study", Idaghdour says.

However, to succeed where many other studies have failed, the team used an approach different from the classic in vitro one, where the genome is analyzed using cells grown in a laboratory. Instead, they used an in vivo approach, analyzing blood samples of children from the Republic of Benin, West Africa, collected with the help of collaborators in the city of Cotonou and the nearby village of Zinvi?. "This approach allowed us to identify how the "environment" engages in an arms race to define the clinical course of the disease, in this case the environment being the number of parasites detected in the child's blood running against the genetic make-up of the infected child", Idaghdour explains.

"We used an innovative combination of technologies that assessed both genetic variation among children and the conditions in which their genes are "expressed". By doing so, we increased the power of our analysis by permitting us not only to detect the mutations, but also to capture their effect depending on how they affect genes being turned "on" or "off" in presence of the parasite", Awadalla explains. "Our approach made us successful, where million-dollar studies have failed in the past. There has never been this many genes associated with malaria discovered in one study."

This major milestone in understanding how the genetic profile affects the ability of children to cope with infection could pave the way to the development of low-cost genetic profiling tests in a not so far future. "Accurate diagnosis of the infectious agent is critical for appropriate treatment, of course. However, determining a patient's genetic predisposition to infection would allow us to be more aggressive in our treatment of patients, whether we are speaking of vaccines or preventive drugs", Awadalla says.

Michael Chabon has returned home. His last novel, The Yiddish Policeman?s Union, took us to an alternate-history Alaska given to the survivors of the 1948 collapse of the newborn state of Israel. Before that, he reached back a thousand years to the Khazar Empire, a half-legendary Jewish kingdom in the Crimean Peninsula, in Gentlemen of the Road, and in that book?s afterword explained why he departed from contemporary realistic fiction: after years writing about the same things as everybody else, he wanted a little adventure. It?s not hard to imagine an alternate-universe version of Chabon in which he takes the Neil Gaiman route, constructing dazzling fantasy and being praised for transcending his genre. But in this universe, those commonplace themes ? love, family, fatherhood, friendship ? matter too much to Chabon for him to stay away for good, and so Michael Chabon has returned home to recent-past California, to Telegraph Avenue right on the borderland between Berkeley and Oakland, to a record shop named for that fuzzy boundary, Brokeland, and the lives and loves and families of the two men who run it.

One thing Chabon brought back with him from his literary walkabout was a taste for the epic. Ever since The Amazing Adventures of Kavalier & Clay, Chabon has been nothing if not ambitious. Kavalier & Clay was a sprawling magnificent beast of a book, six hundred pages and change. Telegraph Avenue may not have quite the thickness, but it feels no less an epic for all that, a window on two families having the kind of year after which nothing is the same. The men, Nat Jaffe and Archy Stallings, one white, one black, best of friends and business partners, have operated their decreasingly profitable record store. Now it?s the dawn of the iPod age, and if that weren?t bad enough, a deep-pocketed billionaire and former NFL quarterback Gibson Goode wants to build a massive entertainment complex right in the neighborhood, with everything up to and including a used-vinyl department. (And as an aside to anyone who has worked in the kind of business where you routinely hear ?I?ll just get it on Amazon,? Michael Chabon clearly sympathizes.) Meanwhile, their wives, Aviva Roth-Jaffe and Gwen Shanks, themselves partners in a well-established midwife practice, are suddenly on the receiving end of a malpractice claim and facing the loss of hospital privileges after a birth goes wrong, even as the due date for Gwen and Archy?s long-delayed first child nears. And Nat?s son Julius is in love with another boy, Titus Joyner, who is Archy?s long-estranged unacknowledged son from a brief relationship before his marriage to Gwen. And on top of that, Archy?s own father, fallen blaxploitation kung-fu legend (!) Luther Stallings, has resurfaced, looking for money and perhaps something else, something related to a thirty-year-old secret from the Black Panther years. It?s an ambitious setup for a story that is well-supported throughout with a wide array of characters and a sense of real history among the players ? probably Chabon?s best cast since Wonder Boys.

There are a number of reasons a writer might find his way back to familiar ground. Years of failed experimentation, for instance, or a desperate try to recapture the formula that once led to success, or simply an inability to think of anything better. Telegraph Avenue is unmistakably not a product of any of those things. It is instead an experienced writer going back to see if he can do what he always wanted, and repeatedly ? joyously ? discovering that yes, in fact, he can. And then some. I could choose a lot of words to describe Michael Chabon?s return, but I settled on one a while back: triumphant.

IRS pays whistleblower $104 million

(AP) ? First, the government threw Bradley Birkenfeld in prison for helping a former client at UBS AG hide his wealth from the Internal Revenue Service. Now, as part of the same case, the IRS has awarded the former banker $104 million ? yes, million ? for helping expose the widespread tax evasion scheme by the Swiss banking behemoth.

The dizzyingly abrupt turnabout in Birkenfeld's life leaves him with the largest government whistleblower award ever to an individual, said Stephen M. Kohn, one of Birkenfeld's attorneys and executive director of the National Whistleblowers Center. The center is a nonpartisan group that defends employees' disclosures of wrongdoing and waste.

The size of the award, announced Tuesday by Birkenfeld's lawyers and confirmed by the IRS, reflects an investigation that resulted in UBS being fined $780 million. It also led to an unprecedented agreement requiring UBS to give the U.S. government the names of 4,700 Americans who held secret overseas accounts and the recovery by the IRS of $5 billion in back taxes and penalties from other taxpayers with overseas accounts under agency amnesty programs, Kohn said.

More broadly, the award is a resounding signal to other financiers with information about tax wrongdoing that the IRS' program will treat them properly, said Kohn, who in an interview called Birkenfeld "the Babe Ruth of whistleblowers."

"It's not about Brad," Kohn said. "It's about how other sources of information, other bankers view the U.S. whistleblower program."

Birkenfeld has become something of a cause celebre among whistleblowers because of the magnitude of his case and the fact that he was jailed after cooperating with authorities. His lawyers say he discovered UBS' illegal activities in 2005, and after the company failed to change them he went to U.S. authorities with the information in 2007.

Birkenfeld, 47, served 31 months of a 40 month prison sentence after pleading guilty in 2008 to a count of conspiracy to defraud the U.S. related to his work for UBS. The Justice Department said Birkenfeld did not reveal his own misconduct in helping a client, a charge his attorneys say is not true.

As Birkenfeld entered prison in 2010, he called his treatment an injustice, saying, "I'm a proud American who did the best I could for my country and this is how they reward me."

His time was cut short for good behavior in prison and "they did not take one minute off his sentence" for his cooperation with the IRS on the UBS case, Kohn said.

Kohn said Birkenfeld left prison in August and is now confined to a house in a New Hampshire conference center ? he did not say where ? and works as a groundskeeper to satisfy his release requirement for a job. He said his home confinement ends in November, when he will begin three years on parole.

"This is the day I thought would never come," said a statement issued by Douglas Birkenfeld on his brother's behalf. "This is a monumental day not only for me, but for every whistleblower worldwide."

Bradley Birkenfeld did not appear at a Washington news conference held by his lawyers, who said their client did not have government permission to talk to reporters.

Kohn said Birkenfeld has already received his check ? from which the IRS has already withheld taxes. He would not how much was withheld.

Gordon Schnell, a New York lawyer who has handled whistleblower work and is not involved in Birkenfeld's case, said the huge award signaled a possible turnabout by the IRS whistleblower office, which he said has had a reputation for doing very little. The agency's latest annual report said that in 2011, its whistleblower office received nearly 7,500 cases and had a staff of 18 people.

"It's sending out a message to whistleblowers, 'Don't stop coming. Our doors are now open for real and we will listen to you,'" said Schnell.

Still, Schnell said he wondered why the IRS said so little about the award and failed to publicize it energetically to attract more whistleblowers. The agency acknowledged Birkenfeld's award in terse written remarks by a spokeswoman, Michelle Eldridge.

She said privacy laws bar the agency from saying much about the case. She said Birkenfeld signed a disclosure waiver allowing them to confirm his award.

"The IRS believes that the whistleblower statute provides a valuable tool to combat tax non-compliance, and this award reflects our commitment to the law," Eldridge said.

The Justice Department said it would let the IRS comment on the Birkenfeld case.

In a summary of the award provided by Birkenfeld's lawyers, the IRS wrote, "Birkenfeld provided information on taxpayer behavior that the IRS had been unable to detect," including methods used by UBS AG and relationships between people involved in transactions.

"The information provided by the whistleblower formed the basis for unprecedented actions against UBS AG, with collateral impact on other enforcement activities," the agency wrote.

The IRS whistleblower program was strengthened by Congress in 2006 to focus on high-earning tax dodgers, guaranteeing awards for whistleblowers whose information leads to collections of at least $2 million in unpaid taxes, interest and penalties. The agency is allowed to pay an award of up to 30 percent of the collected taxes, interest and penalties.

In its annual report on the whistleblower program, the IRS said it collected $48 million from scofflaws under the program last year and handed out $8 million in awards. That's down from $465 million collected and $19 million in awards in 2010. The report did not explain why the amounts had decreased.

Members of Congress including Sen. Charles Grassley, R-Iowa, who helped write the stronger law, have complained that the agency has not been aggressive enough in paying awards.

"The potential for this program is tremendous, and it's up to the IRS to continue paying rewards and demonstrating to whistleblowers that the process will work and that they will be heard and protected," Grassley said Tuesday.
